Our Policy

All real estate advertised by Upstate Apartment Rentals is subject to the U.S. Federal Fair Housing Act, which makes it illegal to advertise any preference, limitation, or discrimination based on: Race, Color, Religion, Sex, Handicap, Familial status, National origin

Additional protections may apply under state, provincial, or local fair housing laws, which can include safeguards against discrimination based on: Sexual orientation Gender identity or expression Source of income or other social conditions.


We do not knowingly accept or permit any advertisements that violate these laws. All persons are informed that all dwellings advertised are available on an equal opportunity basis.

The Law

Multiple federal and local laws guarantee fair housing access:

Civil Rights Act of 1866: Prohibits all racial discrimination in property transactions. Fair Housing Act: Forbids housing discrimination based on race, color, religion, sex, handicap, familial status, or national origin. Americans with Disabilities Act (ADA): Title III bans discrimination in places of public accommodation, including housing offices. Equal Credit Opportunity Act: Prevents discrimination in credit applications based on race, color, religion, sex, age, marital status, national origin, or use of public assistance.


State and local laws may expand these protections further, including:

Protection against discrimination based on vouchers, subsidies (e.g., Section 8), political beliefs, or language spoken.

For Home Sellers & Landlords

You are legally required to provide equal access to housing. You cannot:

Refuse to rent or sell based on protected classes Set discriminatory terms or conditions Advertise with preferences or exclusions Request agents or brokers act in a discriminatory manner.


Real estate professionals are also legally prohibited from complying with any such discriminatory requests.

For Renters & Buyers

You have the right to:

Access a broad range of housing choices Receive equal treatment in showings, services, and financing Expect housing decisions not based on discriminatory factors Use housing vouchers or subsidies (where protected by local law)Request reasonable accommodations for disabilities Be free from harassment, retaliation, or intimidation
